He didn't know how to but thanks to the advice of a few ppl here he is ohw to the clerks office to get the documentation to petition for and a test. Thanks to everyone.

I don't undertatand why he isn't getting a court ordered paternity test....yes, he would be responsible for paying for it. She won't be able to to dodge that bullet

See this is why it has been taking so long. He called child support and they said that they can't stop the support and that we would have to get the DNA test done ourselves. But she won't take the kid there for the test. She will lie and say meet me at 12 and never shows up. Then we play cat and mouse over and over again. This is driving us crazy.

He can go through the child support office. If he as an order to pay support, he can request a DNA test. Since he signed the birth certificate the court will request that he pays for the test, but at least he will have that settled and on the record. Once the test is completed he can petition to have support stopped, or the Judge can do it on the spot when the results are known. The cheapest way for him would be going through childsupport, unfortunately it may not be the quickest.
When the original test was done did they not mail both him and a mother a copy of the results? If he still has his copy, he can take it to the child support office and ask that it be considered. They will either verify it or request a new one to verify. Either way he accomplishes what he is trying to get done.

Legal aid doesn't handle cases like this. He is either going to have to get an attorney or handle it himself. I would go with the latter first. He needs to call the clerks office or child support office and get himself back in court. Let the judge know that a DNA test was done proving that he wasn't the father and then ask the judge for a court ordered DNA test, since he has no proof to actually show. I'm assuming. He will more than likely have to pay for it. After that, they may or may not drop the child support case, but it depends on the State. Since he did sign the birth certificate. But if he explains how he found out about the child not being his, then they will more than likely drop it.
He won't get back pay for all the times he paid though. He will have to take her to civil court for that, which would probably be a waste of time. Especially if she's broke.

That's what the attorney is going to do but for almost $2,000? He can't afford it because of the child support garnishments. See our problem? How can u come up with that much money makingn$150 per week after child support on s kid that's not yours. [:x |
Get a free attorney. Where are you? I can get you a list of legal aide and civil clinic services in your area. DON'T DO THIS ALONE! You need an attorney. Seriously.

Sorry, but my opinion of him has not changed. That girl walked all over him since she met him. He hasn't had a relationship since 2009 over that broad?? Yall babying him way too much. JMO.

First off my brother is not a whimp. You don't know him to Presume such bull. So he is a wimp cause a chick got preggo he thought the baby was his, he took care of her and the kid like a man should? And as much as women complain about black men neglecting their children I think what he did is admirable cause he tried to be in the life of a kid that is not really his kid. There may be wholes to u. I have no reason to lie. Who does that? But I also don't want to write a book about it either. There's so much to tell but would take a lifetime to write it all. Diane that is really effed up. I don't understand why women do this. It hurts and confuses the kid too. Sad.

I really think they need to go ahead and do dna tests at birth. Don't go through life with a child not knowing who the father is. Men should protect themselves and ask for a test. I wouldn't be offended. I know who the father is and know I wasn't messing around. Too much trickery going on.
