so my little brother got into a car accident 7 weeks ago, a 2010 bmw m3 ran a stop sign and hit his vehicle. the police came, determined the other driver was at fault, there was also multiple witnesses.
the person who was behind the wheel was not the owner of the vehicle. as im told he is the son of the owner of the vehicle. my brother is 25, the guy that hit him is 19.

my brother against my advice hired these guys, and was referred to a lawyer



anyway, my brother has pip coverage and his car was a total loss. the lawyers filed a claim on behalf of my brother, and the  m3 insurance company says that the kid that hit my brother isnt on his fathers policy, although he lives in the home, and say they arent responsible for damages Confused

does that sound accurate ? if someone drives your car, and they arent on your policy and you hit someone, your insurance isnt responsible ? they are now in the process of suing the kid on the basis that his father is loaded. i dont think they gonna get a dollar from a broke college kid, but hopefully im wrong.

Most insurance policies have whats called UNINSURED AND UNDERINSURED MOTORISTS.
i would prob still sue them.
I need my car fixed bottom line.
 
TELL HIM TO FIGHT IT.

He needs to fight it out to the very end. Why didn't your brothers insurance company pay for the car and go after the owner of the vehicle?

They are on bullshyt.....when I was that age I had an accident in my moms car and because I live in the house I was totally covered......

Suga he prolly had Liability.

Even with liability you have uninsured/underinsured motorists coverage.  The only thing that "full coverage" includes that liability doesn't is comp, collision, and the add ons like rental reimbursement and emergency road service.

Granted, some people decline/waive uninsured/underinsured motorists coverage to make their premiums cheaper, but it's not typically an option that insurance companies offer. You have to know that you can take it off and then request it to be taken off and then sign some forms saying that you waived your right to have it.  And usually the deductible for that is $250

He definitely should be able to get his sh*t fixed/paid for.  (At least in the state of GA) if someone has your permission to drive your car, that person is covered under your insurance whether you're on the policy or not.

the father is still responsible for his vehicle and who drives it unless he saying the son stole it.  they should go after both the father and son.

Worst case scenario..he doesn't pay up. Your brother wins the lawsuit. Any type of income that young man makes will be garnished. He won't have sh*t to his name for years to come if he doesn't figure it out.

The father's insurance should pay out for your brother's vehicle...they might not pay for damage done to the BMW because the driver was not on the policy.
