Ohio woman sues Toledo hospital for throwing out kidney her brother donated to her 






A Toledo woman and her family are suing the hospital that threw out a kidney her brother had donated to her.

Sarah Fudacz, then 24, was awaiting the kidney from younger brother Paul Fudacz Jr., but a nurse at University of Toledo Medical Center mistakenly tossed the organ, which was sitting in a temperature-controlled slush machine, before it could be transplanted in the Aug. 10, 2012, operation.

The bungle happened when circulating nurse Melanie Lemay, who was covering for part-time nurse Judith K. Moore during her lunch break, failed to properly update Moore on the status of the surgery after she returned from her break, according to hospital disciplinary records obtained by the Toledo Blade. Moore then unknowingly discarded the kidney along with other contents of the slush machine. The kidney was recovered but was unusable.


The hospital found another kidney for Fudacz and paid for her transportation to Colorado to receive surgery Nov. 13, 2012, the Blade reported.

But the Fudacz family, including parents Paul Fudacz Sr., Ellen Fudacz and four other siblings are seeking additional damages to the tune of $25,000 each, citing medical negligence and loss of consortium.

Paul Jr.’s kidney was considered a ‘perfect match’ for Sarah. Sarah seeks damages she has suffered and will continue to suffer due to the loss of Paul Jr.’s perfect kidney. Paul Jr. seeks damages he has suffered and will continue to suffer for having to undergo a painful and risky surgery, and for having to live the rest of his life with only one kidney, all in vain,” the suit reads.


The hospital filed to dismiss the loss of consortium claims, but not the medical negligence, according to the Toledo Blade. A university representative told the paper he did not know how much the school had compensated the family thus far.

The hospital shut down its live donor transplant program for a time following the incident, but it has resumed after review. The surgeon involved in the transplant, Dr. Michael Rees, still works at the hospital.

Moore, the nurse who mistakenly discarded the kidney, resigned Sept. 10, 2012. Lemay was fired for "procedural infractions," and is suing the hospital for wrongful discharge, defamation, slander and libel.

You would think they would have organs labeled and scanned in a safe location. The article makes it sounds as if  the kidney was just sitting in a bucket of ice.

Damn, they got so many donors donating kidneys they can just throw healthy ones away now?

I keed.  Yes, someone needs to get paid and safety measures surrounding the transplantation of organs needs to be updated.

The hospital is the former Medical College Of Ohio. Attorneys from The State Attorney General's office, is representing the hospital. They are not known to offer fair settlements. They are nit picking at things regarding the complaint. The family has a lot of support and excellent Attorneys, and they are in this for the long haul.

There are six hospitals in the region, to service residents in Toledo, suburbs and outlying areas. This is one hospital I refuse to ever be a patient of. Through the years they dropped the ball with patients there, sadly they did not reach our Toledo Blade or other news outlet. It is great that this one did, and it is not settled in silence and swept under the rug.

communication is extremely important in an enviroment like a hospital..

u should see it at the hospital. where i work at...memo's posted all througout the hospital pertaining to communication.
special codes to use when abbreviating certain medicines, no shortcuts when writing out prescriptions etc..


nurses arrive at work 1/2 hour before their shift begins to find out what is going on and what is what..

no communication here is what happened and that is not acceptable at all

25,000 each..shoot i would be owning the dayum hospital itself, employees lives, their children lives and so on
