The Duval County Public School District in Florida says Circuit Court Judge Henry Davis cannot ban a 14-year-old girl from every public school in the county, even if Davis says the student poses a serious danger to others, CBS News reports.

Davis issued his injunction after a March fight hospitalized eighth grader Aria Jewett. According to First Coast News, the membranes surrounding her brain had torn, and cerebrospinal fluid was leaking after what Jewett now calls an ambush.

CBS reports that Jewett's attacker lured her off campus and slammed her head against a stone wall, fracturing her skull, before pinning her to the ground and landing repeated blows. Jewett estimates 30 others watched the assault, and some shot video on their cell phones.

The beating was so severe, it prompted Davis to write in the injunction, "This child is a threat to all of the children at any school."

Jewett's family attorney, John Phillips, told First Coast News that expelling Jewett's alleged attacker was necessary to ensure her safety. But Davis' move to remove the accused from the district entirely surprised even him. John Phillips told the Florida Times-Union he is honored that Davis issued the injunction, but he said he thought it was “a little much” when he first heard it.

The student was charged with aggravated assault, but school officials say that the accused student -- who according to Jewett has attacked up to five students in taped fights -- still has the right to a public education under Title IX of the state's constitution.

CBS News reports an appeals court suspended Davis' injunction, but it's unclear to which school the student will return. A statement issued to CBS by the student's lawyer said his goal is to simply return her to any public school, so her school year can continue.

Why is she fighting everybody, they need to get her some mental help. Something is going on with that child for her to be fighting so many kids and beating them so severely.

I don't mind the ban. expell her and arrest her. Make her go to school in jail. She is a threat to everyone...

I don't know why we cry for the perps and try to make them the victims.

If the judge didn't sentence her to a long stay in a Juvenile Detention Center then I don't see the point in banning her from the school district. Even if she's forced into attending school many miles away from home, how is that a deterrent from her fighting someone else?

Homeschool that beast.  I wouldn't want my kids around her.

She's lucky she isn't locked up in juvy where she belongs IMO.

that or put her in an alternative school. or....make her parents pay for school.

I think her parents bailed her out and she and the 2 kids that filmed it are facing criminal charges.  Apparently, they'd pick people to beat up, film it and then post the footage on youtube.
