Here's some more info.  Apparently Mcmillian was either wrestling or fighting someone else when the officers approached him according to a  cbs news report.  That was what initially caught the officer's attention.  Still think they used unnecessary force on a kid.  Hopefully the judge will dismiss the case.   

Miami-Dade Police Detective Alvaro Zabaleta told D’Oench it was just after 11:00 am on Memorial Day on Haulover Beach when officers saw McMillian slamming another teenager on to the sand.

“They told him that behavior was unacceptable,” said Zabaleta. “He walked away and officers followed him. They asked where his parents were. He said he was not going to take them to them. When he started to leave the beach area, officers had to get off their ATVs to detain him. He had closed arms, clenched fists and pulled his arm away.”

“Once he was approaching the road, the officers restrained him. Again his body language was that he was stiffening up and pulling away,” said Zabaleta. “Now you’re resisting officers at that point and when the hands are swinging and you are resisting officers, at that point you have to be taken into custody.”

McMillian was charged with resisting arrest with violence, a felony, and disorderly conduct. Miami-Dade Police said he had been arrested once before for robbery.

At the Juvenile Justice Center, an Assistant Public Defender entered a plea of not guilty for McMillian. He also asked that the state reconsider the charges against McMillian.

But Judge Maria DeJesus Santoveria declined to do that and said McMillian’s trial would start at 9 a.m. on July 16th.

    who was forced the ground and head-locked by Miami-Dade police because, among other things, they claimed he was giving them "dehumanizing stares," had his day in court this morning.

    McMillian was also facing two unrelated charges, but all charges will be dropped on the condition that he successfully completes a juvenile diversion program.

    McMillian also faced another charge of strong arm robbery for pushing another child off of his bike and taking it, a charge of burglary of a structure for allegedly entering a fenced-in yard and taking a puppy, and a charge resisting arrest without violence for the incident at Haulover Park in May. (There's no confirmation that the puppy he was carrying during the Haulover charges is the same one he's alleged to have taken.)

    McMillian entered a plea deal today. For the next two years he'll be on probation and must complete the Empowered Youth Program. He'll have to attend meetings two to three times a week at the Tacolcy Center in Liberty City; officials claim the program has a history of success in steering young boys away from further involvement in the criminal justice system.

    If McMillian successfully completes the program, sticks to the terms of his probation and avoids any other charges during the next two years then all charges will be officially dropped and removed from his record.
