Arrest made in attack of girl, 12, during French Quarter Fest

New Orleans police have arrested a man they say attacked a 12-year-old girl during the French Quarter Festival over the weekend.

Police booked Jerry Sylve, 37, on charges charges of simple battery and cruelty to a juvenile after witnesses said he punched the pre-teen several times after she refused to give him money. 

The incident came as the nearby French Quarter Festival was winding down, about 7:30 p.m. Sunday (April 13). Police said the girl was standing with a couple of her friends near the intersection of Canal Street and Convention Center Boulevard when Sylve, who was shirtless at the time, approached the group and asked them for money, an officer wrote in a police report. 

The group told Sylve that they did not have any, police said, and Sylve began punching the girl in the face several times before slamming her down on the ground and fleeing the scene. 

Several witnesses to the violent assault found a police officer who was standing nearby and pointed to Sylve running away. The officer arrested Sylve on the scene. 

In addition to the battery and cruelty to juvenile charges, police booked Sylve with possession of marijuana, records show.

Sylve, who records show lives in the 38200 block of Derogeros Lane, has been arrested before in Slidell on charges of filing false reports, reckless operation and resisting arrest. He has no criminal record in Orleans Parish.

Sylve is being held in lieu of a $75,000 bond.

Special education teacher booked with child PICS possession in Washington Parish

A special education teacher at Mt. Hermon Junior High School in Washington Parish has been arrested and booked with child pornography possession, and authorities have said additional charges could be forthcoming. According to the Washington Parish Sheriff's Office, Murray J. "Joey" Duncan Jr., 45, was arrested Wednesday (April 16) and is being held in the Washington Parish Jail on a $50,000 bond.

Sheriff Randy Seal said in a news release that Duncan's arrest followed an investigation into a complaint about sexual abuse involving a juvenile. Seal said that investigation is continuing and that his office plans to file additional charges against Duncan.

Duncan allegedly confessed to improper behavior with juveniles and to possessing child PICS. Seal said Duncan gave investigators consent to search his home, where they found child PICS.

Seal said Duncan was involved in activities that put him in contact with kids at athletic, church and camp events. According to Mt. Hermon's website, Duncan also was the boys basketball coach.

Seal said Duncan admitted to improper sexual behavior with at least two children at a church summer camp that was held in another parish. Those incidents are being investigated, Seal said.

Seal also indicated that Duncan could face charges from agencies in other jurisdictions. He did not elaborate.

"Sexual exploitation of our children is a crime which defies explanation, but it is a crime for which Mr. Duncan will be held responsible," Seal said. "I congratulate our investigators and other agencies involved for arresting this predator and placing him in jail where he belongs."

10-year-old boy brings loaded handgun to elementary school in Thibodaux, report says


A 10-year-old boy is accused of bringing a loaded handgun to a Thibodaux elementary school Wednesday, according to the Lafourche Parish Sheriff's Office. Administrators at Thibodaux Elementary learned that the student had a .380-caliber pistol in his book bag and the school's resource officer found it there and confiscated it, according to this story posted on WVUE Fox 8's website.

Investigators learned the boy brought the gun to school to show it to his friends. It belongs to his stepfather, the story said. The boy is in custody pending a hearing, the story said.

Gretna man sentenced to 60 years for beating, raping prostitute

A Gretna man convicted of raping and brutally beating a heroin-addicted prostitute in aMarrero scrap yard got a 60-year prison term Thursday. A judge gave Terrence Payne, 24, the maximum sentence allowable by law for attempted manslaughter and forcible rape in connection with the June 22, 2012 crime.

The punishment, Judge Scott Schlegel of the24th Judicial District Court said in rejecting Payne's innocence claims, was "commensurate with the violence you perpetrated."

"If I could give you more, I would," Schlegel told Payne. 

The woman, 35, whose name is being withheld, told the jury during a trial last week she was addicted to heroin and turned to prostitution to support her habit. And that's what she was doing on that afternoon, when she agreed to sex with Payne for $20, she testified. She followed Payne to the scrap yard on Alice Street at Barataria Boulevard, where he knocked her to the ground and raped her, before taking a heavy object and smashed her skull.

She lost several teeth and suffered 32 facial bone fractures, she testified. Doctors had to remove a bit of bone from the back of her skull to rebuild her left eye socket, she said.

"My beautiful smile is no more, and my facial disfigurement has lowered my self-esteem," she testified Thursday, breaking down into tears at the witness stand and leading her family in the court to shed tears, too.

She said she is a recovered addict, "a survivor, a conqueror, a warrior, a mother, a daughter, a grand-daughter." She broke into tears at the witness stand, leading her family in the audience to do the same.

"The same god who delivered me can deliver you, young man," she told Payne. She immediately left the courtroom and cried loudly in the hallway. She did not return to court to see Payne receive his punishment.

Payne, who did not testify during his trial last week, told a Jefferson Parish Sheriff's Office detective following his arrest last year that he and the woman agreed to have consensual sex for $20. He said he did business with her, and she was fine when he left.

In court Thursday, Payne attacked the woman's credibility. "The victim's trying to make it seem like she's an angel," Payne told Schlegel.

He accused Assistant District Attorney Matt Clauss, who prosecuted him, of having "a personal vendetta" against him, because of an acquittal in an unrelated case. He then turned on his public defender, George Vedros. "My state lawyer sold me out," he told the judge.

"Now you're about to take my life, because y'all say I raped her," Payne said, repeating his defense that the sex was consensual.

Schlegel heard him out and then cut him off. "You brutally raped a female who was addicted to heroin and weighed 100 pounds," the judge told him, handing down the sentence.

Schlegel sentenced Payne to 40 years for the forcible rape conviction and 20 years for the attempted manslaughter. He ran the sentences consecutively.

Clauss will seek more prison time for Payne under the state's habitual offender law, because of his criminal history. Payne's sentences potentially could double, to 40 for the attempted manslaughter and 80 for the forcible rape.

Marrero man sentenced to 90 years for killing toddler, trying to kill mother

After more than two days of wrangling over whether to accept a plea deal as his trial began, aMarrero man admitted Wednesday he killed his girlfriend's 3-year-old son, and tried to kill her, too, when he sought to burn down their house. Timmie Reed, 36, was sentenced to 90 years in prison, in the Feb. 12, 2013, death ofDesmond Brown, and the attempted murder of his mother, Lakisha Brown.

"I don't have a clear understanding to why someone would hurt such an innocent little angel," Brown told Reed as he pleaded guilty in a Jefferson Parish courtroom. "Even though justice is being served today, there is nothing that can be done to take away the pain and the hurt you caused me and my family when you took the life of my baby."

Reed had taken Desmond and his own twin children to Uptown New Orleans earlier that day, for Mardi Gras parades, authorities said. Afterward, he dropped off his children elsewhere then drove home with Desmond, Assistant District Attorney Vince Paciera told jurors. Reed lived with Brown.

It was unclear when the child actually died. The following day, Brown went into one of the bedrooms, where boxes of clothing were kept. Some of the clothing was on the floor. She began picking it up. At first she thought the body under the pile was a doll. It was her son's body.

She tried to get out of the house, but the front and back doors' were double-locked, and she had no keys. She broke out a window and ran to a neighbor's home to call 911.

Sheriff's Office deputies arrived to find the house smelling strongly of gasoline. They found two cans of gasoline dumped over on side of the house, next to a partially burned rag. Arson investigators concluded someone tried to burn down the house, but the rain and wind that day doused the fire before it could spread.

The coroner's office concluded Desmond died from"homicidal asphyxiation."That could include suffocation or strangulation.

The motive for the crimes is not known.

Authorities arrested Reed the following day, He was charged with second-degree murder and attempted second-degree murder. Had he been convicted of those charges, he would have faced mandatory life in prison for murder and as long as 50 years in for trying to kill Brown.

As his trial was starting Monday, his attorney, Martin Regan, and prosecutors began discussing a plea deal but couldn't agree on a prison term. The defense's initial offer included a 50-year sentence, which prosecutors rejected.

With a panel of jurors sitting idle in a vacant courtroom Tuesday, Reed remained undecided. Judge Conn Regan of the 24th Judicial District Court eventually ordered jury selection to resume.

Then on Wednesday morning, after the jury saw photographs of the toddler's body and as the second witness began testifying, Reed decided to plead guilty. The prosecutors, Paciera and Sunny Funk, reduced the murder charge to manslaughter but left the attempted murder charge intact. Regan sentenced Reed to 40 years for manslaughter and 50 years for attempted murder, the maximum allowed by law for both offenses. Regan then ran the sentences consecutively, meaning Reed's sentence is 90 years.

Regan invited Reed to provide a statement. The defendant declined. 

The judge ordered him to say what he did. "Yes, I committed the manslaughter of Desmond Brown," Reed said. "Yes, I attempted to try to kill Desmond's mother."

Brown cried throughout her testimony. "I hope you see Desmond's face every time you close your eyes, and feel remorsefully for the crime you committed," she said.

She said she moves forward in life with her son in her heart. "That is something you can never take away from me," she said.

She concluded her testimony by saying, "Mommy loves you," looking skyward as she blew her dead son a kiss.

They didn't speculate but I'm guessing he died from carbon monoxide poisoning or something similar?

Dead man found dangling from exhaust system at Marrero store


A man was found dead dangling over the stove in a Marrero store Saturday (April 19), Jefferson Parish Coroner Gerry Cvitanovich has confirmed. Employees discovered the man after 10 a.m. at a store in the 900 block of Westwood Drive, according to the Jefferson Parish Sheriff's Office 911 Emergency Operations Center.

Authorities suspect the man may have been trying to break into the business and became trapped. The man has not been identified, nor has there been a ruling in a cause of death.

"They found his feet dangling from the exhaust system over the stove,'' Cvitanovich said.
