You're welcome. He is also in Franklin TN as well calling himself Tre Emerson III, and has put on facial hair. In the commercial his medical license was in the back and it said Charles Emerson III. @Harmonii...no this was a white man that adopted some black children from Haiti. The last research I did on him was back in December I think and he had fled to memphis to work. I called the office where he worked in Nashville after that and told them I wanted to set up a retouch appointment with him, and they never told me he didnt work there anymore, until I finally let them know that I knew he wasn't working there. i hate you had to go through all this.  I swear that man's name sounds so familar.  I feel like he is the same one in Atlanta that was covered by the news for doing the lipo procedures and he wasnt supposed to. a patient actually did because he didn't administer the anesthia properly.  If it's the same man his business did close in atlanta.  Was he African American? and did he had curly type hair? i swear his name is familar.

I called my lawyer on May 31 to make sure we still had court and the secretary tells me that it has been moved again, because of a conflict. I was pissed, because I wondered why no one had called and let me know. I was listening to my voice mails today and seen that they had called me on May 24 to set up a meeting with me about the case for the next week, but they still never said in the voicemail that the date had been moved.

I assume they moved it though, because they didn't get ahold of me when they called. So now, my court date is June 29...I am getting so sick of this and hope this is the last time it gets moved.

@Harmonii- thanx for telling me, but even though it takes months, its been over a year and my stomach never got flat, actually it had gotten somewhat bigger, until I started taking some diet pills this past April and I am losing weight now including my stomach.

but just wanted to let you know i had a tickle lipo procedure performed and asked my doc about the comment your's made regarding a black person's fat, and he said it is true.  It may be hard to prove negligence if you weren't injured because some people's results vary and it takes months to show actual results. 
 
 i hate that you lost all that money and hope you're able to refunded. please let us know the outcome

The update is that I go to court on January 18, 2012. My lawyers will be going with me and they will be asking for $25,000. They said I can ask up to that amount. They are also including me in a Class Action Lawsuit against HRC Medical with other people that have made complaints.
 
So I will update you guys further after January 18, 2012.

Thank you!! I go see a lawyer tomorrow about suing and I will bring what you said up to him and see what he says. He said he's trying to get a class action lawsuit against that office anyway and is already representing clients. So I am going to write down what you said and present it to him. Thank you so much!! About the fat and ethnicity, I thought that sounded strange. I know he could see that look I gave him when he said it. I also told my lawyer that over the phone and he laughed! So no, I didn't fall for that.LOL I will be in contact with you again after tomorrow. I will let you know what the lawyer said and maybe you can provide me with more help or suggestions. Thank you. I met him , but it was only by my request, because they had no intention of me meeting him prior to surgery. Found out he doesn't even work at the place, I called trying to get an appointment for a retouch (just to see what they say, because I am not letting them do more surgery) the lady said we have a doctor flying in a few times a month to do the surgery and when I get in contact with her secretary I will call you with dates she can do it. So then I said, "that's fine and dandy, but what happened to Doctor Emerson?" She said, "well he doesn't work here, he decided to focus more on cosmetic procedures and works at a different office."

Umm, isn't lipo a cosmetic procedure?Confused I go to see a lawyer tomorrow. Hopefully I can get something done about this.

First let me say I'm sorry this happened to you. As far as suing, the statute of limitations is three years for your situation. This would fall under "Breach of contract and warranty to achieve a specific result". Any reputable attorney should be able to at least get reliance damages (what you paid) and possible expectancy damages depending on your state laws. I can provide some assistance in pointing you in the correct direction for your case (current Health Law student with valid 711 license). And FYI, fat is not based on ethnicity. White and black people's fat is made of the same substances so dont fall for that as an excuse.

I am pissed right about now, so I want to let you all know that the body jet lipo is a scam. I got my surgery done November 2010 on my abs. Went to see my doctor in Feb. 2011 or March 2011, can't remember. He then tells me that black women's fat is stubburn and that is why my stomach had no results. Confused Ok, I'm pissed because he should have told me that before I forked over $4200 for this procedure. He did say that I could keep coming back for touch ups until I am satisfied, for free!

I have been reluctant to do so, but I look up his info this morning and seen that he has moved to Memphis. He was in Nashville. Ok, so I then call his secretary who told me to call the office,because he (the secretary) didn't work there anymore. Angry So I just called the office 10 minutes ago and said, "I am calling to schedule and appointment with Dr. Emerson for the body jet lipo." She said hold on, I guess she transfered me, but I got no answer, so then she comes back and said give me your name and number and I will have Casey call you back to schedule that.

Not once did she say that Dr. Emerson had moved to Memphis. I am not looking to get a touch up cause this business was on the news this morning about their botch Hormone Replacement Therapy and people are trying to sue. It has almost been a year since the surgery and Idk if statue of limitations has run out or not to file a claim against them. Although, they had me sign a form stating that I can't get a refund. So idk what to do. I just want to tell you guys to be careful when looking for someone to do any type of procedure. I saw warning signs like when they never offered to show me any before and after pictures. I had to ask. And then they were scrounching around to find some and when she did, I could tell those pictures where not picutures that the doctor had took in his office. She then told me well, we don't have the book of all of the procedures he's done, becuase he's teaching a class today and took it with him.Confused That was before I paid. Also I had to ask to see the doctor before my procedure was too get done. I wasn't even gonna meet him, they were just going to schuedule me for the surgery and was just going to see him the day of the surgery. ConfusedAnother red flag. When I saw him, upon my request, it was in a small waiting room and all he did was have me raise up my shirt and then said I am a good candidate.

When doctors do this.....Run!!!
